What Do Restaurants Need From Commercial Property Insurance?

Who owns what decides what you insure. In ISO's Building and Personal Property form (CP 00 10), the building includes permanently installed machinery and equipment and personal property you own that is used to maintain or service the building, including appliances for refrigerating, ventilating, cooking and dishwashing. Your business personal property includes furniture, fixtures, machinery, equipment, stock and your use interest as tenant in improvements and betterments, meaning fixtures and alterations you paid for and cannot legally remove.1

A lease or lender can set the minimum. One provider lists restaurants among the businesses commercial property commonly fits and names lease, lender, landlord and property valuation requirements among what the cover usually handles. For a tenant, the ISO form's debris removal cover excludes property owned by or leased to your landlord unless you have a contractual responsibility to insure it and it is insured under your policy, so the lease matters.1,4

Rating can follow the kitchen. One broker says restaurant premiums may be rated on the building's square footage and the value of the kitchen equipment, and one insurer says businesses with many people on the premises, like restaurants, will likely pay more. California's insurance department adds that building rates reflect construction, sprinklers and fire protection class.3,5,6

Which Commercial Property Exposures Do Restaurants Face?

Fire protection can become a condition of cover. ISO's Protective Safeguards endorsement has a symbol for an automatic commercial cooking exhaust and extinguishing system with a hood, grease removal device, duct system and wet chemical extinguishing equipment. If it is scheduled, you must keep the system, as far as you control it, in complete working order and notify the insurer if you know of any suspension or impairment. The insurer will not pay for fire loss if you failed to comply before the fire. Notice is not needed when part of the system is shut off by breakage, leakage or freezing and you can restore full protection within 48 hours.2

Kitchen equipment and buildouts may be paid at less than replacement cost. In the ISO form, replacement cost applies only if it is added; otherwise loss is valued at actual cash value, and appliances for refrigerating, ventilating, cooking and dishwashing are valued at actual cash value even when attached to the building. A tenant's improvements and betterments are paid at actual cash value if you repair promptly, at a share of original cost based on how much of the lease remains if you do not, and at nothing if others pay for the repair.1

Refrigeration can fall into a gap in the base form. ISO's special causes of loss form excludes mechanical breakdown, changes in temperature affecting personal property, and a utility failure that originates away from your premises. Spoilage cover comes from an endorsement: ISO's Spoilage Coverage insures perishable stock only for the causes marked on its schedule, refrigeration breakdown or refrigerant contamination and power outage. Its exclusions include disconnecting the refrigeration from its power source.2

What Should Restaurants Check Before Buying Commercial Property Insurance?

Ask whether a cooking-system condition applies, and what you must do to keep cover. If a protective safeguards endorsement is attached, the condition is to maintain the system in complete working order, so ask the insurer what records it expects you to keep. Do not assume the quote answers this.2

Ask how equipment and improvements are valued, and run the coinsurance test with your own numbers. The ISO form reduces payment when the limit is lower than the stated coinsurance percentage of the property's value, and an Agreed Value option, if shown in the declarations, removes that test. California's insurance department says replacement cost is also subject to coinsurance.1,6

Ask for spoilage, equipment breakdown and power interruption by name, with each cause and limit. The spoilage schedule has a field for a refrigeration maintenance agreement, so ask whether the insurer requires one. Ask too when business income starts: in ISO's Business Income and Extra Expense form (CP 00 30), the period of restoration for business income begins 72 hours after the loss, while for extra expense it begins immediately.2

What Do Restaurants Ask About Commercial Property Insurance?

It can, but check conditions. ISO's special causes of loss form covers direct physical loss unless the loss is excluded or limited, while a Protective Safeguards endorsement can condition fire cover on keeping a cooking exhaust and extinguishing system in working order. Ask whether your quote attaches it.2

Does Commercial Property Insurance Cover Food Spoilage for Restaurants?

Not for refrigeration breakdown or off-premises power loss under the base form. ISO's special form excludes mechanical breakdown, temperature changes affecting personal property and off-premises utility failure. Its separate Spoilage Coverage endorsement insures perishable stock only for the causes marked on its schedule.2

Who Insures a Buildout for Restaurants That Lease Space?

It depends on your lease. The ISO form covers a tenant's use interest in improvements and betterments it paid for and cannot legally remove, and pays nothing for them if others pay for the repair or replacement. Read the lease to see who must insure the buildout before you set limits.1
