What Do Restaurants Need From General Liability Insurance?
Your lease is a first test. One broker lists restaurants among the businesses general liability commonly fits and says it typically comes up when a landlord asks for a certificate of insurance. A second broker describes a restaurant chain with nearly 100 locations leased from 30 different entities, each with its own lease. It says a review found the leases created up to $1,000,000 of risk the chain's liability policy did not cover, and that it amended the policy language to close the gap. That is one broker's account of one client, not a typical result.2,3
Food that leaves your dining room is treated in a different part of the form. The ISO form's products-completed operations hazard covers injury that occurs after goods have left premises you own or rent, when it arises out of your product, except products still in your physical possession. "Your product" includes goods you sell or handle, and a separate aggregate limit applies to the hazard. Ask how your quote treats takeout food that harms someone after it leaves your premises.1
Which General Liability Exposures Do Restaurants Face?
Alcohol changes the answer. The ISO form excludes injury you may be liable for by causing or contributing to someone's intoxication, serving a person under the legal age or under the influence, or a statute, ordinance or regulation on alcohol sales, and the exclusion applies if you are in the business of serving alcohol. One insurer describes liquor liability as an optional add-on to general liability for food businesses, so ask whether yours is an endorsement or a separate policy.1,4
A kitchen fire in rented space is capped separately. The form's exclusions c through n do not apply to fire damage to premises rented to you, and that coverage is capped by its own Damage To Premises Rented To You Limit, which the form makes subject to the each-occurrence limit. A lease clause that indemnifies the landlord for fire damage to the premises is carved out of the form's "insured contract" definition.1
Injuries to your own staff and damage to borrowed equipment are outside the form. It excludes bodily injury to your employees in the course of their work, obligations under workers' compensation law, property you own, rent or occupy, property loaned to you and personal property in your care, custody or control. A cook burned at the fryer is your employee, not a guest. Rented kitchen equipment and a guest's property you are holding fall on the excluded side.1
What Should Restaurants Check Before Buying General Liability Insurance?
Tell each insurer your alcohol sales before you ask for a price. One insurer's published casualty appetite targets restaurants with under 30% liquor sales, avoids bars and nightclubs, and sets a $50,000 minimum premium per policy. Another underwriter ordinarily declines nightclubs and bars. Your share of sales from alcohol may decide whether a market quotes you at all.5,6
Send your broker the insurance, indemnity and fire-damage clauses from every lease and ask for written confirmation that the policy matches them. That is the kind of mismatch the broker's case study describes.1,3
Report incidents promptly. The form requires you to see that the insurer is notified as soon as practicable of an occurrence that may result in a claim, with the time, place and names of injured people and witnesses, and medical payments must be reported within one year of the accident.1

If you serve alcohol, plan on it. The ISO general liability form excludes liquor liability for businesses that serve alcohol, and one insurer describes liquor liability as an optional add-on for food businesses. Ask whether your quote carries it by endorsement or as a separate policy.1,4
Does General Liability Cover Fire Damage to Rented Space for Restaurants?
Partly. The ISO form pays fire damage to premises rented to you under a separate Damage To Premises Rented To You Limit, but the part of a lease that indemnifies a landlord for fire damage is not an insured contract. Compare that limit with your lease.1
Does General Liability Insurance Cover Injuries to Restaurants' Employees?
No. The ISO form excludes bodily injury to your employees in the course of their work and obligations under workers' compensation law. One broker's coverage table puts work-related employee injuries under workers' compensation, which focuses on employees, while general liability focuses on third parties.1,2
