What Do Real Estate Businesses Need From Commercial Property Insurance?

An owner and a tenant insure different things. One provider lists building owners and commercial landlords alongside tenants with valuable inventory or equipment among the common industries that often need property cover. In the ISO form, the building is what the owner insures, and a tenant's use interest in improvements it paid for and cannot legally remove is the tenant's business personal property. Check each side's policy against the lease.1,4

Lenders are a second audience. One provider says commercial property comes up when a lease or lender asks for property coverage. The ISO form's mortgageholder condition lets a lender named in the declarations receive loss payment even if it has started foreclosure, and keeps that right in some cases where the insurer denies your claim because of your acts.1,3

Providers describe their real estate appetite in different terms. One says it focuses on softer occupancies such as municipalities, hospitality, commercial real estate and healthcare. Another lists developers, owners, managers, REITs, merchant builders, community associations and lenders as clients, across multifamily, industrial, retail, office, hospitality and affordable housing properties. Give each your property types and uses before you spend time on a quote.5,6

Which Commercial Property Exposures Do Real Estate Businesses Face?

Vacancy changes what the policy pays. In the ISO form, a building you own is vacant unless at least 31% of its total square footage is rented to a lessee that is conducting its customary operations, or used by you for yours, and buildings under construction or renovation are not considered vacant. After more than 60 consecutive days of vacancy, the insurer does not pay for vandalism, water damage, theft, attempted theft, building glass breakage or sprinkler leakage unless the system is protected against freezing, and it reduces payment for other covered causes by 15%.1

Lost rent is a separate grant. ISO's business income form offers Rental Value as an option: net income that would have come from tenant occupancy plus continuing normal operating expenses, including payroll and charges that are the tenant's legal obligation but would otherwise be yours. A business income period begins 72 hours after the loss, and extended rental value ends at the earlier of the date you could restore tenant occupancy or 60 days after tenantability is restored.2

Code upgrades are limited. ISO's special causes of loss form excludes the enforcement of any ordinance or law regulating construction, use or repair. The ISO building and personal property form's Increased Cost of Construction cover applies only to buildings on a replacement cost basis, pays only the minimum standards of an ordinance in force at the time of loss, and is capped at the lesser of $10,000 or 5% of the building's limit. It does not pay for a law you had to comply with before the loss and did not.1,2

What Should Real Estate Businesses Check Before Buying Commercial Property Insurance?

Give the insurer your occupancy and plans. Report how much of each building is leased and in use, any units you expect to leave empty, and any renovation, because the ISO test turns on the 31% figure and on whether a building is under renovation. Ask what the policy requires you to do before a building passes 60 days of vacancy.1

Set up rent cover on purpose. Ask whether your quote uses business income including rental value, or rental value only, what waiting period applies and how the extended period is set. Ask how charges that are a tenant's legal obligation but would otherwise be yours are counted.2

Ask about flood, earthquake and code upgrades as separate lines. California's insurance department says earth movement and flood are common exclusions under open-perils property coverage, and the ISO special form excludes flood and surface water. Ask what the Increased Cost of Construction limit is on your quote and whether it can be raised.2,7

Check your loan documents against the policy. Make sure the mortgageholder is named in the declarations and that the quote's valuation and coinsurance terms match what the lender requires. The ISO form gives a mortgageholder 10 days' notice if the insurer cancels for nonpayment, and 30 days for other reasons.1,3

What Do Real Estate Businesses Ask About Commercial Property?

Does Commercial Property Insurance Cover a Vacant Building for Real Estate Businesses?

Not fully after 60 days. In the ISO form, a building vacant for more than 60 consecutive days loses cover for vandalism, water damage, theft, glass breakage and sprinkler leakage, and other covered losses are reduced by 15%. An owner's building counts as vacant unless 31% of it is leased and in use or used by you.1

Does Commercial Property Insurance Replace Lost Rent for Real Estate Businesses?

Only if the policy includes rental value cover. ISO's business income form offers Rental Value, covering net income from tenant occupancy and continuing operating expenses during a period of restoration that starts 72 hours after a covered physical loss.2

Do Lenders Require Commercial Property Insurance for Real Estate Businesses?

Your loan agreement decides, so read it. One provider says commercial property comes up when a lease or lender asks for property coverage, and the ISO form has a mortgageholder condition that protects a named lender's right to loss payment.1,3
