What Last-mile delivery insurance Requirements Apply in Indiana?

Indiana Code chapter 8-2.1-19.3 applies after June 30, 2024, to a delivery network company that uses a digital network to connect customers with drivers for delivery of goods. During the delivery-available period, primary liability is at least $50,000 per person, $100,000 per incident, and $50,000 property damage. During the delivery-service period it is at least $1 million per incident. The passenger-network chapter is a different rule: its property-damage floor rose from $25,000 to $50,000 after June 30, 2024, and its on-ride limit is $1 million, but that chapter is limited to transporting passengers.

    Chapter 8-2.1-19.3 is the delivery-network insurance rule, and it applies after June 30, 2024. A food or parcel driver who is only 'available' is in the $50,000/$100,000/$50,000 period. The $1 million limit starts in the delivery-service period, not merely because a passenger-network quote uses $1 million on a ride. 3

    For a transportation network company, chapter 8-2.1-19.1 sets property damage at $25,000 per incident before July 1, 2024, and $50,000 per incident after June 30, 2024, while logged on and not on a prearranged ride. A renewal that still shows $25,000 property damage is using the expired passenger figure. 1

  • Do Not Mix the Passenger Chapter into a Goods Route

    The definitions treat a prearranged ride as transportation of a rider, and they put delivery of goods in the delivery-network chapter.
