What Do SaaS Companies Need From Cyber Insurance?
Expect customers to ask about cyber and tech E&O together; one provider says the request commonly comes up in security reviews. Several providers sell the two as one blended policy for technology companies, and another says buyers can choose cyber, E&O or both. If you buy a blend, ask whether each part has its own limit.3,4,5,6
Your cloud provider secures only part of the stack. Amazon Web Services describes shared responsibility: it protects the infrastructure that runs its services, and the customer is responsible for security in the cloud, which varies by service but can include configuring and patching its own guest operating systems, databases and applications. In one carrier's specimen cyber policy (form edition 12/13), the Security and Privacy section treats hosted cloud resources you contract for as part of your computer system. Ask how a quote treats an incident that starts in a cloud setting you configured.1,7
You hold your customers' business data, not only personal data. In the specimen, confidential information includes any third party's trade secrets, data, designs, forecasts and other non-public items in your care, custody or control or for which you are legally responsible, alongside personal and health information. Check that a quote's definition reaches the customer content your product stores.1
Which Cyber Exposures Do SaaS Companies Face?
Downtime is your product, and a cyber policy may pay for it only when a security failure causes it. In the specimen, the network interruption section pays loss that results solely from a security failure, after a waiting period measured in hours, and defines loss as net income that would have been earned plus continuing expenses such as payroll. Its computer system also includes systems of an outsource provider you depend on, but the specimen caps loss from a security failure at an outsource provider at $100,000. One carrier's brochure describes contingent business interruption as the part that adds losses from interruptions of others' systems. Ask what happens when an outage has another cause.1,2
Customers who demand to be named on your policy get less than you may expect. In the specimen, an entity you are required by contract to add as an insured is covered only for your acts that result in a security failure or privacy event, not for its own. Before you promise an additional-insured endorsement in a security addendum, find out what it would cover.1
A weakness in widely used software can reach many companies at once, and you may sit on either end of it. One carrier's 2021 brochure describes endorsements for widespread events, including software supply chain exploits, that let coverage, limits, retentions and coinsurance be tailored, and a neglected-software endorsement that gives full coverage for 45 days and then gradually re-weights risk sharing between insurer and insured for software left unpatched beyond that. If you ship software to customers or build on others' code, ask whether your quote has comparable terms and how your patching speed affects them.2
What Should SaaS Companies Check Before Buying Cyber Insurance?
Underwriters may ask how dependent your customers are on you. One carrier's short-form application (10/16 edition) asks how many records of protected information you hold, including those secured by third parties under contract, whether backup and recovery are tested at least annually, and whether you have a contingency plan if a customer is primarily dependent on your service. Gather those answers first.8
Ask which losses sit at the full limit. One provider's broker program lists dependent business income, system damage and business income at the full policy limit, and reputational harm, social engineering and funds-transfer fraud at lower sublimits. A policy limit is not one number: find out which of your likely losses, including an outage at a provider you rely on, sit at the full limit and which sit at a sublimit.4
Test the security conditions before you apply. The same program lists multifactor authentication as required for accounts above a stated revenue level and no involvement in crypto, blockchain or cannabis, and another provider's blended product is aimed at technology businesses with up to $1 billion in revenue. Published appetite is a starting point, not an offer; ask each market whether your product and size fit.4,5
