Does General Liability Cover Privacy Violations?
CGL privacy wording does not provide full data-breach or regulatory coverage; cyber insurance may cover specified response costs and claims.
CGL may cover a narrowly defined invasion-of-privacy offense, but that is not broad coverage for a data breach, regulatory inquiry, or response costs. Electronic-data exclusions can also limit a claim involving lost or inaccessible information.
Ask the insurer to separate privacy liability from incident response, customer notice, forensics, and data restoration. Compare the CGL and cyber policy definitions, exclusions, reporting rules, defense costs, and sublimits.
