Does Commercial Umbrella Cover Employers’ Liability?

Sometimes—a commercial umbrella may add limits above scheduled employers’ liability, but it does not pay workers’ compensation benefits and must list the relevant coverage.

That does not mean an umbrella pays workers’ compensation benefits or covers every employment-related claim. Workers’ compensation responds under a separate statutory system, while employers’ liability addresses certain employer liability claims under its own terms.

The umbrella may require the workers’ compensation and employers’ liability policy to be listed, with specified limits. It can also contain exclusions or other conditions that affect a claim. Whether an employee injury fits within the scheduled coverage and umbrella wording depends on the facts and policy language.

Check the schedule for employers’ liability, not merely a generic reference to workers’ compensation. Compare required limits, insured entities, exclusions, attachment language, and any state-specific endorsements with your workers’ compensation policy and contracts.
