Section 303.190 requires a Missouri motor vehicle liability policy to provide, exclusive of interest and costs, $25,000 because of bodily injury or death of one person, $50,000 because of bodily injury or death of two or more persons, and $25,000 because of injury to or destruction of property. Section 510.265 separately caps punitive damages against a defendant at the greater of $500,000 or five times the net amount of the judgment awarded to the plaintiff against that defendant. The cap does not apply if the state is the plaintiff seeking punitive damages, or if the defendant pleads guilty to or is convicted of a felony arising out of the acts the plaintiff pleads. It also does not apply to specified housing-discrimination claims. Schedule the umbrella above the auto policy’s $25,000/$50,000/$25,000 floor, and ask whether any punitive count falls inside an exception.

What to Watch for With Umbrella and Excess Liability in Missouri

  • The punitive cap is the greater of $500,000 or five times the net judgment

    Section 510.265 measures five times the net amount of the judgment awarded to the plaintiff against that defendant, and it compares that product with $500,000. A small compensatory judgment can still produce a $500,000 punitive ceiling. A large net judgment can produce a ceiling well above $500,000. Ask the broker whether the excess form follows punitive damages or excludes them, because the statute caps the award and does not decide what the policy covers. 2

  • A felony conviction or a state plaintiff removes the cap

    The limitation does not apply if Missouri is the plaintiff requesting punitive damages, or if the defendant pleads guilty to or is convicted of a felony arising out of the acts or omissions the plaintiff pleads. Specified housing claims under section 213.111 are also outside sections 510.265, 510.261, and 510.263. If the complaint is paired with a felony charge, do not underwrite the loss as if $500,000 were the maximum punitive verdict. 2

  • The auto floor is a split limit, exclusive of interest and costs

    Section 303.190 states the three amounts exclusive of interest and costs. An umbrella that requires a $1 million combined single limit on the auto policy is asking for more than the statute. An umbrella that schedules only $25,000 per person may meet the statute and still fail the excess form’s own underlying-limit warranty. Compare the declarations with both numbers. 1
