Texas inland marine insurance: commercial exemption and personal prior approval

TDI's commercial inland marine checklist, updated November 10, 2021, says some inland marine classes are non-filed and tells filers to use the Texas definition in 28 TAC §§ 5.5001–5.5008 to decide. The May 2025 Filings Made Easy guide lists commercial inland marine as exempt from Insurance Code chapter 2301 form filing and chapter 2251 rate filing. It lists personal inland marine as prior approval for forms and file-and-use for rates. The current rule text on the Texas Register viewer did not open.

  • Non-Filed Commercial Classes Depend on the Rule Definition

    The checklist says some classes of inland marine are non-filed and points filers to 28 TAC §§ 5.5001–5.5008. Those rule sections did not open on the current register viewer, so this guide does not restate their subclasses. Ask the insurer which section it used to call your equipment or shipment non-filed, and read the form for theft, transit, and premises terms. 1

  • Personal Inland Marine Forms Are Prior Approval

    The May 2025 Filings Made Easy guide lists personal inland marine as prior approval for forms and file-and-use for rates. A personal article floater is not on the commercial exemption. Ask which track the quote is on before you compare it with a contractors' equipment policy. 2

  • Commercial Inland Marine Is Exempt From Two Filing Chapters

    The same guide lists commercial inland marine as exempt from chapter 2301 form filing and chapter 2251 rate filing. An exemption from filing is not an exemption from exclusions. Ask for the issued form even when TDI did not have to approve it. 2

Who Regulates Insurance in Texas?

TDI licenses agents and insurers, reviews company rate filings, and investigates complaints against insurance companies and people it regulates. Its complaint page states limits on what it can resolve, including disputes outside its regulatory authority. 3,4,5

When Texas is the insured’s home state, the state tax is 4.85% of gross premium; absent a compact allocation agreement, a multistate policy can be taxed on its entire premium. Policies effective on or after Jan. 1, 2024 also carry a 0.04% stamping fee; SLTX invoices the broker and says the insured pays it, and the surplus-lines insurer is not covered by the Texas guaranty association.
