A company that wants to deviate must file and get the superintendent's approval before using the deviation. Separately, Ohio Rev. Code § 3935.04, effective October 24, 2024, says the usual form and rate filing duty does not apply to inland marine risks which by general custom are not written according to manual rates or rating plans.

What Should You Watch for With Inland Marine Insurance in Ohio?
A Deviation From the 1976 Definition Needs Approval
Rule 3901-1-23 does not reprint consignment, installation, or equipment subclasses. It says inland marine risks shall be established by the December 9, 1976 nationwide definition, and that any company wishing to deviate shall make a formal filing and obtain the superintendent's approval before using the deviation. The rule's five-year review date is August 31, 2027. Ask whether your class is inside the definition or under an approved deviation. 1
Non-Manual Inland Marine Skips the Ordinary Filing Duty
Section 3935.04(A) requires filing of forms and rates except as to inland marine risks which by general custom are not written according to manual rates or rating plans. Specific inland marine rates on risks specially rated by a rating bureau shall be filed, and those bureau-made rates become effective when filed. Division (J)'s ban on issuing a policy except in accordance with filings in effect does not apply to inland marine risks as to which filings are not required. 2
The Filing Exception Is Not a Coverage Term
A risk that does not have to be filed can still exclude theft from an unattended vehicle, tools over a sublimit, or property at your premises. Ask the broker to point to the form's transit, jobsite, and premises clauses. The authorized-kinds statute lists inland marine but does not define those subclasses. 2,1
