Start by asking which form you need, because insurers use the same words for different products. One broker says that in the medical and legal industries this coverage is often called malpractice insurance, and that doctors and lawyers have specialized coverage for their industries. A national insurer lists a Physicians & Surgeons professional program marked "PL only".1,2
A generic E&O form is written for advice, not treatment. In a carrier's specimen professional liability policy, claims arising from bodily injury are excluded, and professional services means only the services listed in an endorsement. Before you accept that wording, ask where a claim that treatment injured a patient would land.4
Budget for the class. One insurer says premiums vary with business size, industry, location and claims history, and that financial advisors, attorneys and healthcare providers land at the top of its range because larger contracts and more complex client relationships mean more exposure.5
Which Professional Liability Exposures Do Healthcare Providers Face?
Technology and regulation add exposures beyond treatment. One insurer's allied healthcare program lists technology-based care, covering telehealth, virtual care and AI-driven services, as a module, and lists regulatory, reputational and data liability enhancements, HIPAA violations, disciplinary actions and off-label treatment among its features. If you treat patients, price a clinical professional liability form next to the E&O quote and compare what each one excludes. Ask the insurer to say in writing whether bodily injury, pollution and patient-data claims are covered, sublimited or excluded.3,4
Name every service and every kind of provider. In the specimen, professional services are only those listed in an endorsement, and an independent contractor is an insured only while performing professional services for the organization. List each service, each licensed provider type and any contract clinicians, and ask that all of them are named.4
Ask how regulators and licensing boards are handled. The specimen's definition of damages leaves out fines, penalties and sanctions levied against you, while one insurer lists disciplinary actions as a feature of its allied healthcare form. Ask what your quote pays for a board complaint or an investigation, and up to what limit.3,4
Check claims timing before you sign. In the specimen, you must give notice of a claim by the end of the policy period or an optional extended reporting period, with a 60-day allowance only for claims made in the last 60 days. Ask for the retroactive date and the price of extended reporting before you change carriers or leave a practice.4
