Media Liability in Minnesota
For Minnesota publishing work, keep written, broadcast, and newspaper content categories distinct: libel and slander generally have a two-year filing period, while statutory retraction and third-party-broadcast provisions apply to narrower media formats.
What Is Media Liability Insurance?
Media liability can help pay defense costs for claims about content you create or distribute, such as allegations of defamation or infringement. Consider it if you publish or produce content for your business or clients; match the quote to each activity. Read the national Media liability guide.
What Should You Watch for With Media Liability Insurance in Minnesota?
Calendar the two-year libel and slander period
Minnesota includes libel and slander among actions generally commenced within two years. Track publication and claim dates, then compare them with the policy’s separate claim-reporting and retroactive-date terms. 1
The retraction statute is written for newspaper libel
Section 548.06 applies to libel published in a newspaper. It requires the plaintiff to serve the publisher at its principal place of publication with notice identifying the statements and requesting withdrawal; failure to publish the specified retraction within one week permits a claim for general as well as special damages. Even after a retraction, general damages may remain unless the defendant shows the publication was made in good faith and under a mistake as to facts. Candidate publications have added placement and election timing conditions, and the section excludes libel imputing unchastity. 2
A broadcast defense is limited to another person’s statement
Section 544.043 concerns a defamatory statement in a radio broadcast made by someone other than the station, its agents, or employees, and requires due care. Its text does not create a general defense for online video, print, or a broadcaster’s own statement. 3
Which Providers Have Documented Minnesota Licenses?
These providers publish a national listing for Media liability; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm the product is available in Minnesota. Check the regulator’s license lookup and confirm state availability for your business when requesting a quote.

Surplus-Lines Tax and Stamping Office in Minnesota
Reported tax rate. 3% of taxable gross premiums less return premiums, plus a 0.04% stamping fee on taxable premium when Minnesota is the insured's home state 7,10,8,9,11
When Minnesota is the insured's home state, 3% tax applies to taxable gross premiums less return premiums; the separate 0.04% stamping fee on taxable premium is paid by you to the broker. Minnesota requires a policy warning that insolvency loss payment by a nonadmitted insurer is not guaranteed. A diligent search generally applies unless a Minnesota-licensed producer unaffiliated with the surplus-lines broker refers the risk, which the statute deems unavailable from a licensed insurer; an exempt commercial purchaser also has a separate written-request route after the required admitted-market disclosure.

Media Liability Insurance in Minnesota: Frequently Asked Questions
Does Minnesota’s newspaper retraction procedure cover a web post or client campaign?
Section 548.06 is written for libel published in a newspaper. Do not extend it to other formats without legal advice; ask the insurer how the quoted policy treats your actual distribution channels. 2
Does Minnesota’s radio and television provision guarantee a defense?
No. Section 544.043 addresses a narrow liability defense for a statement made by someone else in a radio broadcast when the station shows due care. It does not decide policy coverage. 3
