Do Independent Contractors Need Workers’ Comp?

A contractor may need workers’ compensation if the state classifies them as your employee; a contract label alone does not decide status.

New York says a worker under a company’s direct control may count as an employee even if treated differently for tax purposes, and it applies industry-specific tests. Other states have their own rules.
