## What Do Contractors Need From Workers' Compensation Insurance?

Your license can depend on it. California's licensing board says a contractor must keep proof of workers' compensation on file or sign a statement that it has no employees, and that lapsed coverage suspends the license; roofing and several other trades cannot use the no-employee exemption. In Texas, where the state insurance department says most private employers can choose whether to carry workers' compensation, a government entity that signs a building or construction contract must require the contractor to certify in writing that it provides coverage, and each subcontractor on the project gives the general contractor its own certificate. Your claims history follows you into bids. NCCI says the experience mod compares an employer's own losses, usually over the latest three years, with similar employers, then scales premium up (a debit above 1.00) or down (a credit below 1.00). Public owners ask for it when they prequalify bidders: Denver's rules make a contractor ineligible if its three-year average mod is 1.5 or higher, and Virginia's transportation department asks for a mod letter and three years of OSHA logs. ## Which Workers' Compensation Exposures Do Contractors Face?

An uninsured subcontractor can become your problem. Florida's workers' compensation division says that if a subcontractor lacks coverage for its employees, those workers become the contractor's employees and the contractor pays benefits for any work-related injury. Washington's labor department says a general contractor can be held responsible for a subcontractor's unpaid premiums unless it can show six listed conditions, including that the sub's account is in good standing. The bill can also arrive at audit. NCCI's standard policy form sets final premium after the policy ends from the actual, not the estimated, premium basis (usually payroll), and counts payments to people whose injuries could make the insurer liable unless you prove their employers secured their own coverage; without payroll records, the contract price may be used. Georgia's insurance commissioner says that without that proof your insurer will charge for the work the subcontractor did. The size of that charge is set by rule. North Carolina's manual, for one, charges extra premium for an uninsured sub: its payroll if records are complete, otherwise the full contract price, unless job documents show a definite payroll amount, which is then subject to minimums such as 90% of the price for labor only and 50% for labor and material, rated at your class and mod. How your crews are classified drives the rate. Verify each subcontractor before the job starts. Georgia's insurance commissioner says to confirm the details on a sub's certificate rather than trust it. Washington's labor department lets you look up a sub's workers' compensation account online and sign up for a letter if it stops paying, and says to check the certificate of coverage each year and keep a copy on file. Settle your own owner and officer status. A California licensee can certify it employs no one, but hiring anyone ends the exemption and starts a 90-day clock to file a certificate of coverage. Florida lets up to three officers of a construction company who each own at least 10% elect to be exempt, and an exempt officer cannot recover benefits. Plan for the audit before you buy. The quote is an estimate: the standard policy lets the insurer audit during the policy period and within three years after it ends.
