## How We Ranked Product Liability Insurance Providers for Manufacturers

Spot lists a provider only when its published Product Liability Insurance information includes a documented claim (verified or company-reported) about eligibility, role, coverage or application that mentions manufacturers. “Named for Manufacturers” marks a provider’s own statement of who it serves; “Related mention” marks a role, coverage or application claim.

## What Do Manufacturers Need From Product Liability Insurance?

Your customers set a floor. The Insurance Information Institute says a retailer may not sell your product unless you have product liability coverage, and that financial backers may require it too. Walmart's supplier requirements, for example, call for commercial general liability including products and completed operations, product liability limits tiered by product category, Walmart named as additional insured, and prefer occurrence-based policies; if a policy is claims-made, they add conditions on the retroactive date and an extended reporting option. Those terms are Walmart's, not an industry standard. Distributors and retailers may ask to be covered under your policy. ISO's vendors endorsement makes a named vendor an insured for bodily injury or property damage arising out of your scheduled products, but it excludes the vendor's sole negligence, repackaging and physical or chemical changes it makes, and the most paid is the contract's required amount or your limit, whichever is less. Describe your actual role. The Insurance Information Institute says you may be liable in a product lawsuit even if your role is limited: you might supply a single small part of a larger product, your design might be safe but a contract manufacturer produces a flawed unit, or you might only repackage and distribute products made elsewhere. ## Which Product Liability Exposures Do Manufacturers Face?

Product claims usually run through the general liability form. The Insurance Information Institute says product liability coverage can be added to a general liability policy or bought as a stand-alone policy. In ISO's specimen, the products-completed operations hazard includes injury and damage away from premises you own or rent that arises out of your product, and it has its own aggregate limit, separate from the general aggregate. A bad product year can use up that aggregate while the general aggregate sits untouched. Recall costs fall outside the policy. The specimen excludes losses, costs or expenses incurred by you or others for the withdrawal, recall, inspection, repair, replacement, removal or disposal of your product when it is withdrawn or recalled because of a known or suspected defect. The Insurance Information Institute treats recall as separate cover for costs such as advertising to launch the recall, shipping to collect products and product destruction, and California's insurance department lists sistership liability, where a maker fails to withdraw a product a regulator or the company ordered recalled, among exclusions. Component makers face a gap. The specimen excludes property damage to impaired property, which includes tangible property that cannot be used or is less useful because it incorporates your product known or thought to be defective and that could be restored by repairing, replacing, adjusting or removing your product, when nothing was physically injured. The exclusion does not apply to loss of use of other property arising out of sudden and accidental physical injury to your product after it has been put to its intended use. Your labels and instructions are part of your product. The specimen's definition of your product includes containers, warranties and representations about fitness, quality, durability or performance, and the providing of, or failure to provide, warnings or instructions. The Insurance Information Institute says that if instructions, warnings or promotions lead to misuse resulting in injury or damage, your company could be found liable. ## What Should Manufacturers Check Before Buying Product Liability Insurance?

Ask what happens to products you stop making. In the specimen, the policy that responds is the one in force when the injury or damage occurs. One carrier's flyer says an occurrence policy protects you from product failures only while it is still in force, and describes discontinued products coverage for claims occurring after general liability coverage ends because a business ceases operations or a product line is discontinued. Ask whether you can buy it and how long it runs. Match endorsements to your buyers. List every distributor or retailer whose contract asks for additional insured status, and ask whether your quote includes a vendors endorsement and for which vendors. Walmart accepts additional insured status or equivalent wording, so ask your buyer what form it expects. Get a recall quote separately. The Insurance Information Institute says recall coverage can be added or purchased separately. Ask which costs it pays, what triggers it and whether it needs a government order, because the general liability specimen pays none of them. Know your regulator's clock. The CPSC says manufacturers, importers, distributors and retailers of consumer products must notify it within 24 hours of obtaining reportable information (a company unsure whether information is reportable can take a reasonable time to investigate, which should normally not exceed 10 working days), and lists insurance claims or payments and product liability lawsuits among the information a company should review. That is a regulatory duty for consumer products, not a policy term, so also read your policy's notice conditions. ## What Do Manufacturers Ask About Product Liability Insurance?

Not the recall itself. Often because a buyer requires it.
