## What Do Real Estate Businesses Need From General Liability Insurance?

The kind of real estate business you run decides which policy answers. One insurer's general liability page describes real estate agents who host open houses and showings, where a third party can be hurt or property damaged. The Insurance Information Institute puts real estate agents and brokers on its list of professionals who should consider professional liability, and says claims for negligence, misrepresentation and inaccurate advice are ones general liability does not cover. If you hire a property manager, check what the policy says about it. The ISO form makes any person other than your employee or volunteer worker, and any organization, an insured while acting as your real estate manager. Read your management agreement against the policy so you know who is insured and for what. Insurers can sort property types. One insurer's published casualty appetite lists commercial real estate as a target class and habitational as an avoided class, so a habitational owner and a commercial landlord can get different answers to the same question. ## Which General Liability Exposures Do Real Estate Businesses Face?

The ISO form names landlord conduct. Its personal and advertising injury definition includes wrongful eviction from, wrongful entry into, or invasion of the right of private occupancy of premises a person occupies, committed by or on behalf of its owner, landlord or lessor. The same coverage excludes injury caused by or at the direction of an insured who knew the act would violate another's rights, and injury from a criminal act. Your own building and properties you have sold are outside the liability form. It excludes damage to property you own, rent or occupy, and to premises you sell, give away or abandon if the damage arises out of any part of those premises. An exception applies when the premises are your work and you never occupied, rented or held them for rental, so premises you built and never held for rent are treated differently from a building you owned or leased out. A lease can carry insured liability. The form lists a contract for a lease of premises as an "insured contract", which can bring liability you assume in it back inside the policy. The exception is the part of a lease that indemnifies someone for fire damage to premises rented to you or temporarily occupied by you, so check any lease where your company is the tenant. Pollution at your premises is excluded, with exceptions. The form excludes injury or damage arising from pollutants at premises you own or occupy. The exceptions include bodily injury inside a building from smoke, fumes, vapor or soot produced by equipment that heats, cools or dehumidifies the building, and injury or damage arising out of heat, smoke or fumes from a hostile fire. ## What Should Real Estate Businesses Check Before Buying General Liability Insurance?

Describe your property mix before you ask for quotes: commercial, residential or habitational, mixed-use, and whether you manage for others. A market's appetite can turn on that mix, as the habitational exclusion in one published guide shows. Before you rely on a tenant's certificate, look for the endorsement. Oregon's insurance regulator says a certificate informs and cannot change the policy. If your lease requires you to be listed as an additional person covered, that takes a blanket additional insured endorsement or action by the insurer. Ask your broker to show where each of three things sits: claims over advice you gave, which the Institute says general liability does not cover; damage to your own buildings, which the liability form excludes; and visitor and tenant injury claims, which the liability form is built for.
