## Which General Liability Exposures Do Consultants Face?

Two exclusions in the ISO form matter when you handle a client's equipment or files. It excludes property damage to personal property in the insured's care, custody or control. It also excludes damage that results from lost, corrupted or inaccessible electronic data, and its definition of property damage says electronic data is not tangible property. Knocking over a monitor in a client's office is physical damage; the data on a drive is a separate question, and the form excludes it. What you publish carries its own limits. The ISO form's personal and advertising injury coverage includes publication of material that slanders, libels or disparages a person or organization or violates a person's right of privacy. It excludes injury committed by an insured whose business is advertising, publishing, or designing or determining content of websites for others, so a marketing, PR or web consultant should read that exclusion closely. A claim about your advice belongs to another policy. The Insurance Information Institute puts negligence, misrepresentation, violation of good faith and fair dealing, and inaccurate advice on the professional liability side of the line: general liability does not cover them. Tell the insurer where the work happens and who visits. One agency says underwriters weigh your industry's risks, giving the example that a clothing store with heavy foot traffic pays more than a marketing consultant who works from home.
